Justice Department Releases Information on Election Day Efforts to Protect the Right to Vote and Prosecute Ballot Fraud

0

DOJIn anticipation of the upcoming general elections, the Justice Department today provided information about its efforts, through the Civil Rights Division and Criminal Division, to ensure that all qualified voters have the opportunity to cast their ballots and have their votes counted free of discrimination, intimidation or fraud in the election process.

Civil Rights Division:

The Civil Rights Division is responsible for ensuring compliance with the civil provisions of federal statutes that protect the right to vote and the criminal provisions of federal statutes that prohibit discriminatory interference with that right.

The Civil Rights Division’s Voting Section enforces the civil provisions of a wide range of federal statutes that protect the right to vote including: the Voting Rights Act, the National Voter Registration Act, the Uniformed and Overseas Citizens Absentee Voting Act, the Help America Vote Act and the Civil Rights Acts.  Among other things, collectively, these laws:

*prohibit election practices that have either a discriminatory purpose, based on race or membership in a minority language group, or a discriminatory result, with members of racial or language minority groups having less opportunity than other citizens to participate in the political process;

*prohibit voter intimidation;

*provide that individuals who need assistance in voting because of disability or illiteracy can obtain assistance from a person of their choice;

*provide for accessible election machines for voters with disabilities;

require provisional ballots for voters who assert they are eligible but whose names do not appear on poll books;

*provide for absentee ballots for service members, their family members and U.S. citizens living abroad;

*require states to ensure that citizens can register through drivers’ license offices, public assistance and disability services offices, other state agencies and through the mail; and

*include requirements regarding maintaining voter registration lists.

The Civil Rights Division’s Criminal Section enforces federal criminal statutes that prohibit voter intimidation and voter suppression based on race, color, national origin or religion.

On Election Day, Nov. 8, 2016, the Civil Rights Division will implement a comprehensive program to help protect the right to vote, including:

*The Civil Rights Division will conduct monitoring in the field at polling places around the country (locations for monitoring will be announced closer to Election Day).

*Civil Rights Division attorneys in both the Voting and Criminal Sections in Washington, D.C., will be ready to receive election-related complaints of potential violations relating to any of the statutes the Civil Rights Division enforces.  Attorneys in the division will take appropriate action and will consult and coordinate with local U.S. Attorneys’ Offices and with other entities within the Justice Department concerning these complaints before, during and after Election Day.

*Civil Rights Division staff will be available by phone to receive complaints related to voting rights (1-800-253-3931 toll free or 202-307-2767) or by TTY (202-305-0082).  In addition, individuals may also report complaints, problems or concerns related to voting by fax 202-307-3961, by mail to voting.section@usdoj.gov Email links icon and by complaint forms that may be submitted through a link on the department’s website: https://www.justice.gov/crt/voting-section?utm_source=rss&utm_medium=rss.

*Complaints related to violence, threats of violence or intimidation at a polling place      should always be reported immediately to local authorities by calling 911.  They should also be reported to the department after local authorities are contacted.

Criminal Division and the Department’s 94 U.S. Attorneys’ Offices:

The Department’s Criminal Division oversees the enforcement of federal laws that criminalize certain forms of election fraud and vindicate the integrity of the federal election process.

The Criminal Division’s Public Integrity Section and the department’s 94 U.S. Attorneys’ Offices are responsible for enforcing the federal criminal laws that prohibit various forms of election fraud, such as vote buying, multiple voting, submission of fraudulent ballots or registrations, alteration of votes and malfeasance by election officials.  The Criminal Division is also responsible for enforcing federal criminal law prohibiting voter intimidation for reasons other than race, color, national origin or religion (as noted above, voter intimidation that has a basis in race, color, national origin or religion is addressed by the Civil Rights Division).

The U.S. Attorney’s Offices around the country designate Assistant U.S. Attorneys who serve as district election officers (DEOs) in the respective districts.  DEOs are responsible for overseeing potential election-crime matters in their districts and coordinating with the department’s election-crime experts in Washington, D.C.

On Nov. 8, 2016, the U.S. Attorneys’ Offices will work with specially trained FBI personnel in each district to ensure that complaints from the public involving possible voter fraud are handled appropriately.  Specifically:

*In consultation with federal prosecutors in the Public Integrity Section in Washington, D.C., the DEOs in U.S. Attorneys’ Offices, FBI officials at Headquarters in Washington, D.C., and FBI special agents serving as Election Crime Coordinators in the FBI’s 56 field offices will be on duty while polls are open to receive complaints from the public.

*Election-crime complaints should be directed to the local U.S. Attorney’s Offices or the local FBI office.  A list of U.S. Attorneys’ Offices and their telephone numbers can be found at https://www.justice.gov/usao/find-your-united-states-attorney?utm_source=rss&utm_medium=rss.  A list of FBI offices and accompanying telephone numbers can be found at https://www.fbi.gov/contact-us?utm_source=rss&utm_medium=rss.

*Public Integrity Section prosecutors are available to consult and coordinate with the U.S. Attorneys’ Offices and the FBI regarding the handling of election-crime allegations.

*Again, complaints related to violence, threats of violence or intimidation at a polling place should be reported first to local police authorities by calling 911.

Both protecting the right to vote and combating election fraud are essential to maintaining the confidence of all Americans in our democratic system of government.  The department encourages anyone who has information suggesting voting discrimination or ballot fraud to contact the appropriate authorities.

booze it and loose itRALEIGH – Halloween is traditionally a time for ghosts, goblins and all things scary, but drinking and driving can cause true horror. The N.C. Governor’s Highway Safety Program is launching its annual Halloween “BOO-ze It & Lose It” campaign to remind drivers that if you drink and drive, you could pay serious consequences.

“Halloween is a time for fun, but safety is our top priority,” said N.C. Governor’s Highway Safety Program Director Don Nail. “Everyone needs to know that drunk driving will not be tolerated by law enforcement, especially with the significant increase of pedestrians and drivers on our roads.”

In conjunction with the enforcement campaign, state officials will utilize the “Be Smarter Than That” campaign to provide easy access to safe transportation options for members of the public who plan to drink alcohol. The website BeSmarterThanThat.com allows users to designate a sober driver, download a ride app, find public transportation options, and find a taxi based on their location.

The N.C. Department of Transportation and Governor’s Highway Safety Program recommend following these simple tips for a safe Halloween if you plan to drink:

  • Before you put your costume on, plan a way to safely get home at the end of the night by either designating a sober driver, downloading a ride app, checking on public transportation availability or programming a taxi number into your mobile phone.
  • Walking impaired can be just as dangerous as drunk driving. Designate a sober friend to get you home.
  • If you see an impaired driver on the road, contact local law enforcement immediately.
  • If you know someone who is about to drive or ride impaired, take their keys and help them make safe travel arrangements to where they are going.

The mission of the Booze It & Lose It campaign aligns with Governor Pat McCrory’s NC Vision Zero initiative, which aims to eliminate all traffic-related injuries and fatalities through coordinated efforts with public and private partners in traffic safety.

Thousands of North Carolinians have taken the pledge to practice safe driving habits. Join them and find out more at NCVisionZero.org.

The Halloween “BOO-ze It & Lose It” campaign runs from Friday, Oct. 28 through Monday, Oct. 31.

criminal-summonsNC Republican Party Chairman Dallas Woodhouse said on Saturday night he is requesting the Democrat Party remove candidate Tim Benton from the ballot following an altercation that took place between Republican candidate Brenden Jones and Benton. Jones said, “It is sad. It really is.” He added that the town officials of Bladenboro have been very concerned and very apologetic over the incident.

“I’m absolutely shocked at his outburst….I’m good, it’s just unfortunate,” said Jones.

Jones said that when he was confronted by Benton, he attempted to walk away. Jones said he had his hands in his pockets and turned to walk way when Benton threw a punch at him causing Jones to pull back and the blow caught him in the side of the mouth and jaw.

“I tried to walk away. It’s a sad day for District 46,” said Jones.

NCGOP UPDATE: Democrat State House Candidate Charged with Assault

RALEIGH, NC – Yesterday Brenden Jones was victim to an assault by his Democratic opponent Tim Benton while they were at a local family festival. Both are State House candidates for District 46 in North Carolina. A mail piece went out recently stating the similarities between Tim Benton and Hillary Clinton, which caused Benton so much strife that he verbally and physically assaulted Jones in public.

There is absolutely no place for physical violence in our electoral system today,” stated Chairman Robin Hayes. “Tim Benton’s actions are completely unacceptable, and we call on the North Carolina Democratic Party to join us in denouncing this barbaric behavior. Mr. Benton should withdraw his name from the race immediately. We must lead by example, and Mr. Benton has no business representing any part of North Carolina after showing his true colors yesterday.

Democrat Tim Benton has been issued a criminal summons and will appear in court on assault charges. Republican Brenden Jones was not charged and witnesses told local media the assault upon him was unprovoked.

Mr. Benton was completely overwhelmed with misplaced anger because he was being compared to Hillary Clinton, the presidential candidate for his very own party. His inexperience in the political workings of a campaign caused him to assault Brenden and draw even more attention to his own problems. We have ran a clean and respectful campaign concerning the issues that matter most, and Mr. Benton’s actions yesterday are completely unacceptable and uncalled for.” – Mr. and Mrs. Brenden Jones

DETAILS OF THE ASSAULT

Yesterday afternoon Tim Benton spotted Brenden Jones at the local Beast Fest in Bladenboro, NC. He approached Jones very aggressively in front of families, while pushing his own grandson in a stroller. Jones tried to calm him down and asked if they could go across the street to get away from the growing crowd. Benton was spewing profanity, screaming in Jones’ face saying, “I’m going to kick your ass by the end of the day,” and repeatedly nudging his shoulder. The two men went to the other side of the road, meanwhile Benton left his grandson in his stroller on the edge of the street causing Mrs. Jones to divert her attention away from her husband to care for the child. Then Benton proceeded to sucker punch his opponent, Brenden Jones, while Jones kept his hand in his pockets the whole time. Witnesses flocked to Mr. and Mrs. Jones offering support. Countless bystanders apologized to Jones for the behavior of Benton and explained that his actions do not represent their town and its people.

NCGOP to Announce Doubling of Reward for Arrest in Firebombing of GOP Office
Announcement to be Made Tomorrow Morning at Orange County Office Grand Re-Opening

The North Carolina Republican Party will match the reward offered by Governor Pat McCrory, doubling the total reward, for information leading to arrest on the firebombing of the Orange County GOP office.

Previously, Governor McCrory announced a $5,000 reward “for information leading to the arrest and conviction of the person or persons responsible for the firebombing.”

“The firebombing of a local political headquarters was clearly an act of intimidation and I’m going to do everything I can to find the individual or individuals who committed this assault on our democracy,” Governor McCrory said. “I remain committed to using every resource as governor to assist local authorities in this investigation.”

The North Carolina Republican Party is today announcing a $5,000 match to bring the total reward available to $10,000. The announcement will be made at the Grand Re-Opening of the GOP office at a new location just down from the firebombed location.

“We are so proud of our Orange County volunteers who did not let this cowardly act of political terrorism shy them away from their right of free political speech and free association with fellow republicans,” said NCGOP Chairman Robin Hayes.

“This was an attack on all free thinking people. We are proud to stand with the Governor’s office and law enforcment as we continue to search for justice,” continued Chairman Hayes.

The Orange County office of the North Carolina Republican Party will hold an open house to thank the community for assisting the Party in rebuilding after the vicious act of political terrorism that destroyed the Orange County Republican Party Headquarters.

Donated funds have provided the new GOP headquarters state of the art security and video monitoring to deter future acts of political violence.

The new office is located just a few hundred yards from the previous location that was firebombed and spray painted with hateful graffiti, which warned “Nazi Republicans” to get out of town.

Volunteers will also be receiving sample ballots and canvasing instructions as we move into the final stages of the 2016 election.

Four people were arrested after a high speed car chase starting on Highway 87 in Elizabethtown ends in a wreck according to Highway Patrol Sgt. Matt Hardee.

Sunday afternoon around 3:30 pm a driver from Florida with three other passengers jumped the washout on Cromartie Road in Elizabethtown trying to flee from law enforcement according to Highway Patrol Sgt. Matt Hardee.

The driver’s vehicle jumped the washout hitting the drain tile and flipping onto its side according to Hardee.

All four people in the vehicle sustained injuries, none are life threading. All are facing charges. A large amount of alcohol was involved according to Hardee.
